Please read these Terms and Conditions of Sale and Terms of Use of the lebagparis.com website carefully.

Article 1 – Seller

These Terms and Conditions of Sale apply to the sales defined hereinafter, made by LEBAG, a simplified joint-stock company with sole shareholder (SASU) with a share capital of €1,000, whose registered office is located at 19, rue de Marignan, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 978 286 359. Article 2 – Scope and Acceptance of the Terms and Conditions of Sale

The purchase of products offered on the lebagparis.com website (the "Website") and/or by phone is subject to these Terms and Conditions of Sale ("Terms and Conditions of Sale").

The customer certifies that they have the legal capacity to enter into the commitments set out herein.

Article 3 – Product Description

We make every effort to provide accurate product descriptions. However, we do not guarantee that descriptions, images, or any other content are accurate, complete, or error-free.

Displayed colors may vary depending on screen settings or lighting conditions.

Article 4 – Orders and Acceptance

By selecting the "Buy Now" option, your item will be shipped within 48 hours after payment confirmation.

By selecting "Order on Request", you agree to a made-to-order arrangement, meaning that the product will be manufactured specifically for you after the order has been validated. Production time may take up to one month, depending on the complexity of the model.

All orders are subject to our validation. Additional information may be requested before acceptance.

A confirmation email will be sent to you after your order is placed. This email is a summary only and does not constitute final acceptance.

We reserve the right to refuse service or cancel any order at our sole discretion, for reasons including but not limited to product unavailability, suspected fraud, or pricing or description errors.

As our products are handmade, slight variations may appear between models (shade, texture, dimensions, placement of ornaments, etc.). These natural variations cannot be considered as defects of conformity and shall not give rise to any claim, refund, or exchange.

Article 5 – Prices and Payment

Prices displayed on the Website are in euros. They do not always include applicable taxes. Only the price displayed at the time of payment shall be contractually binding.

We make every effort to ensure the accuracy of prices, but errors may occur. In the event of a pricing error after order validation, we will contact you to confirm the correct price or cancel the order.

We accept the following payment methods: Mastercard, Visa, Apple Pay, CB. Payment is due at the time of order.

Article 6 – Delivery and In-Store Pickup

Article 6.1 – Shipping Methods and Lead Times

We ship worldwide via DHL Express. Although we strive to ensure fast delivery, all our products being handmade, the preparation of your order may take up to one month, even when express shipping is selected.

Delivery times are calculated from the date your order is shipped. DHL Express typically delivers within 2 to 5 business days after shipment. Delays may occur for reasons beyond our control (customs, logistical delays, etc.).

Article 6.2 – Shipping Fees

Shipping fees are calculated at the time of order, based on the delivery address and the weight of the order. They will be added to the total amount of your order.

Article 6.3 – Taxes and Customs Duties

Import taxes, customs duties, or any fees applied by the country of destination may be added to the price indicated at the time of order. These fees, if any, remain the responsibility of the buyer and must be paid directly to the customs authorities or carrier upon delivery. The customer is invited to consult their local customs office to understand the applicable terms in their country of residence.

No tax refund (détaxe) can be applied to purchases made on the Website.

Article 6.5 – Order Tracking

Once your order is shipped, you will receive an email containing a tracking number and a link to track your package.

Article 6.7 – Address Accuracy

Please carefully verify the accuracy and completeness of your shipping address. We disclaim any liability for delays or failed deliveries due to an incorrect or incomplete address.

If you wish to change your address after placing your order, please contact us immediately at contact@lebagparis.com. We will do our best to make the change before shipment.

Article 6.8 – Transfer of Risk

Products remain the property of LEBAG until full payment of the price by the customer. The transfer of risk (loss, theft, damage) occurs at the time of delivery of the product to the customer or to any person designated by them.

Article 6.9 – Lost or Stolen Packages

Once the package has been handed over to DHL, we are not responsible for any loss, theft, or damage. In the event of a problem, please contact DHL directly. You may also inform us of any incident, and we will do our best to help you resolve the situation.

Article 6.10 – In-Store Pickup

Customers may opt for in-store pickup by selecting "Pickup" at checkout.

You will receive a notification as soon as your order is ready. Please bring your order confirmation and a valid ID when picking up your order.

Article 7 – Right of Withdrawal

Article 7.1 – Right and Period of Withdrawal

You have a legal right of withdrawal of 14 days, which you may exercise under the conditions provided for in Articles L221-18 and L221-20 of the French Consumer Code, if you meet the conditions set out in these provisions, without having to give reasons and without having to pay any penalties.

Article 7.2 – How to Exercise the Right of Withdrawal

You may send your withdrawal request by contacting our Customer Service or by using the standard withdrawal form template available in the appendix to these Terms and Conditions of Sale.

Article 7.3 – Restriction on the Right of Withdrawal

In accordance with Article L. 221-28 of the French Consumer Code, your right of withdrawal cannot be exercised for orders of personalized Products.

Article 7.4 – Consequences of the Right of Withdrawal

Products must be unused, undamaged, and returned in their original packaging with tags and accessories intact. We reserve the right to refuse any return that does not comply with our policy.

Shipping fees, customs duties, and surcharges are non-refundable. For returns from a country outside the European Union, the customer must clearly indicate on the package: "Return for refund" in order to avoid any new application of customs duties. Any package not complying with these instructions may be refused.

Approved refunds will be made using the original payment method, within 14 days of receipt of the returned product.

Costs (shipping, customs duties, and surcharges) related to the return of the product are entirely the responsibility of the buyer.

Article 8 – Legal Warranties

We offer a one-year warranty against manufacturing defects under normal conditions of use, excluding painted or personalized items, which require special care.

Repairs carried out within 30 days of purchase are free of charge. After this period, a paid after-sales service is available.

In the event of a confirmed defect or non-conformity, we may offer repair, replacement, or refund, at our discretion.

Article 9 – Limitation of Liability

Under no circumstances shall LEBAG and its affiliates be held liable for any damage that does not result from a breach by LEBAG of its legal obligations.

LEBAG's liability shall not be engaged in the event of indirect, special, or consequential damages related to the use of the website or the purchase of Products.

Our liability is limited to the amount paid for the relevant Product.

Article 10 – Applicable Law and Disputes

These Terms and Conditions of Sale are governed by and interpreted in accordance with French law.

In the event of a dispute relating to the application and/or interpretation of these Terms and Conditions of Sale, you may resort to a conventional mediation procedure or any other alternative dispute resolution procedure. In accordance with Order No. 2015-1033 of August 20, 2015 and its implementing Decree No. 2015-1382 of October 30, 2015, any consumer dispute or litigation, subject to Article L. 612-2 of the French Consumer Code, may be settled amicably through mediation with the CMAP – Centre de Médiation et d'Arbitrage de Paris (Paris Center for Mediation and Arbitration).

To submit a dispute to the mediator, the customer may:

  • fill out the form on the CMAP website: www.cmap.fr, under the "You are: a consumer" tab;
  • send their request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, France;
  • or send an email to consommation@cmap.fr.

Regardless of the means used to contact the CMAP, your request must contain the following elements to be processed efficiently: your postal, email, and phone contact details, as well as the full name and address of LEBAG, a brief description of the facts, and proof of prior steps taken with LEBAG.
